In a significant update on the reserved seats case, Chief Justice Qazi Faez Isa has demanded answers to nine key questions from the Supreme Court Registrar regarding a ruling issued on September 14. This comes after further complexities arose following the clarification of the court’s decision on July 12, which had been uploaded to the Supreme Court’s website by a group of eight judges.
In a letter to Registrar Jazira Aslam, Chief Justice Isa referenced a note from the Deputy Registrar, dated September 14, raising similar questions. The Chief Justice’s queries focus on procedural issues, including when the Election Commission of Pakistan (ECP) and Pakistan Tehreek-e-Insaf (PTI) filed their requests for clarification regarding the July 12 decision. He also questioned why these petitions were not forwarded to the Practice and Procedure Committee.
Additional questions raised include how the hearing was scheduled without the case being listed on the cause list, and whether the Registrar’s Office had issued notices to the concerned parties, including the Attorney General. The Chief Justice further asked which courtroom or chamber was used to hear the case, and why no cause list was issued prior to the ruling.
Moreover, Chief Justice Isa sought clarification on how the order was uploaded to the Supreme Court’s website without the original file being submitted to the Registrar’s Office, and who authorized the order to be published online.
This series of questions highlights concerns about transparency and due process, as the case continues to evolve in the judiciary.
